Majelis hakim Pengadilan Negeri (PN) Stabat memvonis Terbit Rencana Perangin – Angin alias Cana dua bulan penjara, Senin (28/8/2023) sore.
Selain itu, Bupati Langkat Nonaktif tersebut juga dikenakan denda Rp50 juta dalam perkara kepemilikan satwa liar dilindungi.
“Menyatakan terdakwa Terbit Rencana Perangin – Angin terbukti bersalah, melakukan kelalaian memiliki hewan dilindungi dalam keadaan hidup, sebagai mana dakwan alternatif kedua Jaksa Penuntut Umum (JPU),” ujar Ketua Majelis Hakim Ledis Meriana Bakara, di ruang sidang Prof Dr Kusumah Admadja Sh.
Ledis melanjutkan, terdakwa dijatuhi hukuman pidana kurungan selama dua bulan dan denda Rp50 juta. Jika denda teresbut tidak dibayarkan, maka diganti dengan hukuman satu bulan penjara.
Pidana terhadap teresebut, kata Ledis, tidak perlu dijalani oleh terdakwa. Kecuali jika di kemudian hari ada perintah lain dan putusan hakim, kareana terdakwa melakukan kejahatan, sebelum masa percobaan berakhir selama empat bulan.
Untuk barang bukti berupa satu ekor Orangutan Sumatera (Pongo Abeli), satu ekor Elang Brontok fase terang (Spizaetus Cirrhatus), dua ekor Burun Beo (Gracula Religiosa), ditetapkan dalam amar putusan untuk diesarahkan ke BKSDA.
Agar satwa – satwa itu dikembalikan ke habitat semula atau dimasukkan ke dalam Suaka Margasatwa.
Sementara, JPU yang telah menuntut Terbit Rencana 10 bulan penjara, masih pikir – pikir untuk menyikapi vonis yang dibacakan majelis hakim.
Hal serupa juga disampaikan Anggun Rizal selaku penasihat hukum (PH) Terbit Rencana.
“Dalam perkara ini kita masih pikir-pikir, apakah memang melakukan hukum yaitu banding dan sebagainya, jaksa juga demikian kan.
Artinya nunggu salinan putusan tadi,” ujar Anggun dan timnya di luar persidangan.
Meski demikian, kata Anggun, putusan itu belum mendapat keadilan yang pasti terhadap Terbit.
Karena, dalam fakta persidangan pihaknya tidak menemukan bahwa kliennya itu memiliki atau memelihara satwa tersebut. Namun putusan berbicara lain.

“Saya berkeinginan sekali suami saya itu dibebaskan. Karena saya rasa, dia (Terbit Rencana) tidak terlibat apa – apa. Begitu pun, segalanya saya serahkan pengadilan.
Pengadilan tentunya tau mana yang benar dan mana yang salah,” tutur Tiorita dengan mata berkaca – kaca.
Diinformasikan, Bupati Langkat nonaktif Terbit Rencana Perangin – Angin, dituntut Jaksa Penuntut Umum (JPU) Kejaksaan Negeri (Kejari) Langkat, 10 bulan penjara pada kasus kepemilikan satwa dlindungi.
“Benar pada Kamis (3/8/2023) terdakwa dituntut 10 bulan penjara oleh JPU denda Rp 50 juta subsider 3 bulan,” ujar Kasi Intel Kejari Langkat, Sabri Fitriansyah Marbun, Senin (7/8/2023) lalu.
Sabri menambahkan, adapun yang menjadi pertimbangan jaksa dalam tuntutan diantaranya, bahwa satwa yang diamankan dalam kondisi yang terawat.
Bahkan, Terbit Rencana Perangin – Angin juga menegaskan, jika kelima satwa dilindungi yang diamankan BKSDA tersebut bukanlah miliknya.
Hal itu seperti yang diungkapkan Terbit saat menjalani persidangan perkara kepemilikan satwa dilindungi dengan agenda pemeriksaan terdakwa di PN Stabat, Senin (10/7/2023) sore yang lalu.
Terbit dipidana, karena kelalaiannya menangkap, melukai, membunuh, menyimpan, memiliki, memelihara, mengangkut, dan memperniagakan satwa yang dilindungi dalam keadaan hidup.
Hal tersebut telaha melanggar Pasal 40 ayat (4) Jo Pasal 21 ayat (2) huruf a UU RI Nomor 5 tahun 1990 Tentang Konservasi Sumber Daya Alam Hayati dan Ekosistemnya, sebagaimana yang tertuang dalam dakwaan alternatif kedua. (Ahm)
